therefore unable to inform the buyer about properties or defects in the item sold that the seller
might have been aware of if he had actually used the item sold himself. In connection with this,
the parties, in derogation of Article 6.3. of this deed of sale and article 7:17 paragraphs 1 and 2
of the Dutch Civil Code, agreed that such properties or defects are for the account and risk of the
buyer and that when determining the purchase price taken into account.
The buyer indemnifies the seller against all possible claims from third parties.
